Article 1. Company

Article 2. Purpose

These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in the context of the online sale of products offered by WECONCEPT. Any order implies unconditional acceptance of these GTC.

Article 3. Products

The products offered are described and presented as accurately as possible. Photographs are not binding and have no contractual value. Offers are valid while stocks last.

Article 4. Prices

Prices are quoted in euros, including VAT (gross price) for consumers and excluding VAT (net price) for business customers. Delivery costs are charged in addition and are specified before order confirmation. In the event of a change in the VAT rate, the gross price may be adjusted accordingly.

Article 5. Orders and Payment

The Buyer may pay for their order by:
– Credit card (secure payment via Stripe – SSL protocol, PCI DSS compliant)
– Bank transfer

Order confirmation constitutes final acceptance of the contract. The Buyer will receive an order confirmation by email.

Article 6. Retention of Title

The products remain the property of the Seller until full payment of the purchase price has been made.

Article 7. Delivery

Products are delivered to the address specified by the Buyer. The Seller bears the transport risk until actual delivery to the consumer. If delivery is delayed by more than 30 days, the consumer may terminate the contract and request a refund.

Article 8. Warranties and Liability

A. Provisions applicable to consumers (B2C)

Right of withdrawal: In accordance with Articles L221-18 et seq. of the French Consumer Code, the Buyer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without giving any reason and with the exception of return costs.

Statutory warranties: Products are covered by the statutory conformity warranty (Articles L217-3 to L217-20 of the Consumer Code) as well as the warranty against hidden defects (Articles 1641 et seq. of the Civil Code).

Liability: The Seller is subject to a result obligation regarding the conformity of delivery.

B. Provisions applicable to business customers (B2B)

Right of withdrawal: not applicable. Orders placed by business customers are firm and final.

Warranties: Only any commercial warranties expressly specified apply. The statutory conformity warranty of the Consumer Code does not apply between business customers. The warranty against hidden defects under the Civil Code remains applicable.

Payment: Invoices are payable upon order unless otherwise agreed in writing. In accordance with Article L441-10 of the French Commercial Code, any late payment automatically results in:
interest for late payment calculated on the basis of the ECB reference rate plus 10 percentage points, and a fixed compensation of €40 for collection costs.

Liability: The Seller is only liable for direct and foreseeable damages. Compensation is limited to the net amount of the order concerned.

Article 9. Intellectual Property

All elements of the website (texts, images, logos, etc.) are protected by intellectual property law. Any unauthorised reproduction or use is strictly prohibited.

Article 10. Personal Data

The processing of personal data is governed by the GDPR and the amended French Data Protection Act. The Buyer may exercise their rights of access, rectification, erasure, portability, objection and restriction via the following form: /contact.

Article 11. Applicable Law – Jurisdiction

A. Consumers (B2C)

These GTC are governed by French law. In the event of a dispute, the consumer may bring an action before the court of their domicile or the court of the place of delivery of the goods.

B. Business customers (B2B)

For disputes between business customers, exclusive jurisdiction is conferred on the Commercial Court of Romans-sur-Isère, even in the case of multiple defendants or third-party claims.
